Jury Deliberates Lindsay Clancy Case

After 80 witnesses and 21 days of testimony, a jury is now deciding the fate of Lindsay Clancy, a Massachusetts mother accused of killing her three children—Cora, Dawson, and Callan—in 2023.

Initially, 18 jurors—12 women and six men—were selected to hear the entire trial. After closing arguments, Judge William Sullivan gave the jury its instructions and randomly selected six jurors to serve as alternates. The alternates cannot participate in deliberations but must remain available if a deliberating juror is unable to continue.

The jurors’ identities have remained protected throughout the trial. They were repeatedly instructed not to discuss the case with anyone or conduct their own research outside the courtroom.

For each child, the jury must choose among four possible outcomes: first-degree murder, second-degree murder, manslaughter, or not guilty due to lack of criminal responsibility.

Clancy’s defense argues that she was suffering from postpartum psychosis and therefore was not criminally responsible for the deaths. Under Massachusetts law, prosecutors must overcome this insanity defense to obtain a guilty verdict.

Guilty Perspective

From the prosecution’s perspective, Clancy intentionally killed her children and should be held criminally responsible for their deaths. The prosecution must convince the jury that, despite her alleged mental illness, she retained enough understanding of the wrongfulness of her actions and enough ability to control her behavior to be legally responsible.

If the jury accepts this argument, it could find her guilty of first-degree murder, second-degree murder, or manslaughter for the deaths.

Not Guilty Perspective

From the defense’s perspective, Clancy’s actions were the result of severe postpartum psychosis that prevented her from fully understanding what she was doing or controlling her behavior. The defense argues that this mental state means she was not criminally responsible, even if she physically caused the deaths.

If the jury agrees that the prosecution has failed to overcome the criminal-responsibility defense, the appropriate verdict would be not guilty due to lack of criminal responsibility.
