On September 8, 2026, Kingston Police officers responded to Cumberland Farms at 41 Main St. for a report of a fight in progress.
Upon arrival, officers spoke with the victim, a Black male, who reported that he was at the gas pumps when a stranger, later identified as the suspect, began yelling racial slurs at him without provocation.
According to the victim, the suspect then charged at him, resulting in a physical altercation. The suspect allegedly kicked the victim, struck him several times, and knocked him to the ground. The victim fought back during the altercation and sustained several injuries, including a suspected compound fracture.
Officers conducted an investigation at the scene and determined that the suspect was the primary aggressor. Multiple witnesses provided statements that appeared to corroborate the victim’s account, describing the suspect as irate and out of control. The suspect also continued to make racial slurs and behave in an irate manner in the presence of responding officers.
Officer Oxsen subsequently arrested the suspect.
After being transported to the police station, the suspect complained of an injury and was transported to a local hospital for evaluation. While in the emergency department, the suspect allegedly continued to behave in a disruptive and irate manner, directing profanity and racial slurs toward officers and hospital staff, making offensive remarks regarding Black people, and making inappropriate sexualized comments.
The investigation also revealed that the suspect has an extensive history of violent conduct.
The suspect was later transported to the courthouse, where he was arraigned.
Officer Oxsen continued investigating the incident in the days that followed. As part of the investigation, officers obtained video evidence from Cumberland Farms that appears to further corroborate the victim’s account of an unprovoked assault.
The suspect has been identified as Gary Phillipo II, 46, of Carver.
Phillipo has been charged with:
- Assault and Battery with a Dangerous Weapon Causing Serious Bodily Injury
- Assault and Battery to Intimidate Resulting in Bodily Injury (Hate Crime)
- Disturbing the Peace
Phillipo remained in custody following his arraignment and is scheduled to return to court next month.
